Terms of use

The terms that govern your use of the AI Capability Assessment Tool. How we handle the information you submit is covered separately in the Privacy Notice. By submitting the assessment, you confirm you have read and agree to both.

Acceptance

These Terms of Use apply to the AI Capability Assessment Tool operated by SP Optima Pty Ltd (ABN 39 697 333 850), based in Victoria, Australia. By accessing or submitting the assessment, you agree to these terms. If you do not agree, do not use the tool.

Your responsibilities

By submitting the assessment, you confirm and warrant that:

Geographic availability

The tool is available to users worldwide, with the following exceptions:

By submitting the assessment, you represent and warrant that you are not located in, ordinarily resident in, or otherwise subject to such restrictions.

About the results

The AI Capability Assessment Tool is a self-assessment instrument. Results are indicative and not certified. They reflect what you reported on a single occasion and the cohort of other voluntary submitters at that point in time.

You can take the assessment in two forms: a quick 35-question version (designed for individuals) or a full 105-question version (designed for business context). Both produce a result on the same AI Capability Index scale. The full version produces a sharper result resolved across every capability; the quick version is a lighter pass through the same framework. Cohort comparisons are shown like-for-like within each version.

SP Optima makes no representation or warranty as to the accuracy, completeness, reliability, or fitness for any particular purpose of the results, the framework, or the dashboard outputs. The tool is provided “as is” and on an “as available” basis.

Decisions about hiring, promotion, compensation, role assignment, performance management, redundancy, licensing, or capability funding should not be made on the basis of these results, whether in whole or in part. To the extent permitted by law, SP Optima excludes all liability for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from use of the tool or reliance on its outputs.

Intellectual property

The assessment framework, including the 7 dimensions, 5 levels, the capability statements, the persona names and descriptions, the scoring weights, and the dashboard visualisations, is the intellectual property of SP Optima Pty Ltd.

You retain ownership of your specific responses. By submitting, you grant SP Optima a perpetual, irrevocable, worldwide, royalty-free licence to use your responses in de-identified and aggregated form for research, content, product development, and commercial purposes.

The dashboard report you receive is for your personal and internal professional use. You may share it with colleagues, managers, or mentors. You may not reproduce, redistribute, or build derivative assessment tools from the underlying framework without prior written permission from SP Optima.

Changes to the tool

The AI Capability Assessment Tool is actively developed and may change over time.

SP Optima may update the capability framework, capability statements, scoring method, Index calculations, persona logic, dashboard outputs, downloadable reports, available features, or access to parts of the tool.

Because the framework may evolve, results submitted under one version of the tool may not be directly comparable with results submitted under another version. Your Index reflects the version of the framework in use at the time you completed the assessment.

Where SP Optima publishes longitudinal, comparative, or aggregated research that spans different versions of the framework, we will take reasonable steps to explain any material changes that affect comparability.

SP Optima may update, suspend, replace, or discontinue parts of the tool over time. We are not required to maintain previous versions of the framework, scoring model, dashboard, persona system, or downloadable outputs.

Privacy

How we collect, use, store and disclose the information you submit is set out in the Privacy Notice. Changes to the tool do not change how we handle your personal information; that is always governed by the Privacy Notice.

Changes to these terms

We may update these terms from time to time as the tool evolves or as legal requirements change. The “last updated” date below reflects the current version, and material changes are flagged via the SP Optima website.

Governing law

These terms and your use of the tool are governed by the laws of the State of Victoria, Australia. Any dispute arising out of or in connection with these terms is subject to the exclusive jurisdiction of the courts of Victoria.
